Williston vs State of ND Mineral Rights Lawsuit

by Kenneth E. DuBose on July 8, 2011

Brigham Exploration has entered this “conversation” regarding mineral rights under the Missouri River and Lake Sakakawea.

“Tom Gray, a consultant who does work as a landman at the Williams County Courthouse, told the Commission that the lawsuit was filed by Brigham Exploration.””Gray said the company filed the suit in an effort to clear up an ongoing legal fight that currently has only been between the city of Williston and the state of North Dakota.”

“The issue involves a dispute over mineral rights under the Missouri River and Lake Sakakawea where Brigham drilled a well last year.”

“Gray explained that after the well was drilled and went into production, the state made a claim on the same acreage the city had leased for the well.”

“The city of Williston filed a Quiet Title Action against the state late last year.”

“Gray advised the county to reply to the lawsuit to protect their mineral interests.”

“Royalty payments have been suspended until the mineral rights dispute has been resolved.”
